These Terms and Conditions of Sale ("Terms") apply whenever you purchase products from the Soleberie website. Please read them carefully before placing an order.
By placing an order, you confirm that you have read, understood and agree to be bound by these Terms.

1.1 This website is owned and operated by Gubblecote Ltd trading as Soleberie ("Soleberie", "we", "our" or "us").

1.4 Your use of the Soleberie website is governed by our Website Terms of Use Policy. By accessing or using our website, you agree to comply with those terms and policies. If you do not agree to them, you should not use the website.
2. Application of these Terms
2.1 These Terms govern every order placed through our website.
2.2 They apply together with:
(a) your order details and any confirmation emails we send you;
(b) our Delivery Policy;
(c) our Returns Policy; and
(d) any documents expressly referred to within these Terms.
2.3 If there is any inconsistency between these Terms and another policy, these Terms shall take precedence unless we expressly state otherwise.
2.4 No variation of these Terms shall apply unless agreed by us in writing.
3. Consumer Sales
3.1 These Terms are intended for purchases made by consumers for personal use.
3.2 We do not sell products through this website for resale or commercial distribution.
3.3 If we reasonably believe an order has been placed for commercial resale or wholesale purposes, we reserve the right to refuse or cancel the order.
3.4 Nothing in these Terms affects your statutory rights as a consumer.
4. Eligibility to Purchase
4.1 By placing an order you confirm that:
- you have legal capacity to enter into a binding contract;
- all information you provide is complete and accurate;
- you are authorised to use the payment method provided; and
- you are purchasing the products in good faith.
4.2 We reserve the right to refuse any order where we reasonably believe:
- fraudulent activity has occurred;
- payment cannot be authorised;
- incorrect information has been supplied;
- these Terms have been breached; or
- acceptance of the order would be unlawful.
5. Products
5.1 We make every reasonable effort to ensure that descriptions, specifications, photographs and pricing on our website are accurate.
5.2 However:
- colours may vary because of individual screen settings;
- images are for illustration only;
- dimensions and measurements are approximate;
- packaging may differ from that shown; and
- minor manufacturing variations may occur.
5.3 Such differences will not constitute a fault provided the product substantially matches its description.
5.4 Our products are intended for normal domestic use only.
5.5 You are responsible for ensuring that the products are suitable for your intended purpose before placing your order.
5.6 Nothing in this clause limits your statutory rights where goods are not of satisfactory quality, fit for purpose or as described.
6. Prices, Promotions and Discount Codes
6.1 All prices are shown in pounds sterling (£).
6.2 Unless stated otherwise, prices include VAT at the applicable rate.
6.3 Delivery charges are calculated separately and displayed before you complete your purchase.
6.4 We may change prices at any time before an order is accepted.
6.5 Price changes will not affect orders we have already accepted.
Pricing Errors
6.6 Despite our best efforts, pricing or product information may occasionally contain errors.
6.7 If we discover an obvious pricing, promotional or product description error before dispatch, we reserve the right to:
- cancel the order;
- refuse acceptance of the order; or
- contact you to offer the opportunity to purchase at the correct price.
6.8 We are under no obligation to supply products at an incorrect price where the error is obvious and could reasonably have been recognised as such.
Promotions and Discount Codes
6.9 Promotions, introductory offers and discount codes:
- cannot normally be combined;
- cannot be exchanged for cash;
- may exclude selected products;
- may exclude delivery charges;
- may exclude previous purchases;
- remain subject to availability; and
- may be withdrawn or amended at any time before an order is accepted.
6.10 We reserve the right to withdraw any promotion and cancel any order where we reasonably believe a discount code, promotional offer or loyalty benefit has been obtained or used fraudulently, dishonestly or contrary to its intended purpose.
6.11 We reserve the right to determine eligibility for promotional offers acting reasonably and in accordance with these Terms.
7. Placing an Order
7.1 Placing products into your shopping basket does not reserve stock.
7.2 When you place an order you are making an offer to purchase the selected products.
7.3 After submitting your order you will normally receive an acknowledgement email confirming that we have received it.
7.4 This acknowledgement does not mean that your order has been accepted.
7.5 We reserve the right to decline any order before acceptance.
7.6 Reasons may include, but are not limited to:
- stock becoming unavailable;
- payment authorisation failing;
- pricing errors;
- suspected fraud;
- suspected resale;
- technical errors; or
- circumstances outside our reasonable control.
7.7 If we decline your order after payment has been taken, we will refund the amount paid as soon as reasonably practicable.
8. Formation of the Contract
8.1 A legally binding contract between you and Soleberie is formed only when we send you an email confirming that your goods have been dispatched.
8.2 Until that point, we reserve the right not to accept your order for any lawful reason.
8.3 If your order contains multiple products, we may dispatch them separately. Dispatching part of an order does not oblige us to supply an item which has become unavailable, in which case we will refund any amount paid for that item.
8.4 Nothing in these Terms shall affect your statutory consumer rights.
9. Payment
9.1 Payment must be made in full before we dispatch your order.
9.2 We accept the payment methods shown during the checkout process. All payments are subject to authorisation by your card issuer or payment provider.
9.3 If payment is declined, refused or cannot be processed for any reason, we will not be obliged to accept or fulfil your order.
9.4 We use reputable third-party payment providers to process payments securely.
9.5 To help protect our customers and our business, we may carry out reasonable identity, security and fraud prevention checks before accepting or dispatching an order. This may occasionally delay dispatch.
9.6 If we reasonably believe that an order is fraudulent, unauthorised, connected with criminal activity or otherwise unlawful, we may refuse or cancel the order without liability to you. Where appropriate, any payment received will be refunded using the original payment method.
9.7 If you believe there is a problem with your order, we ask that you contact us first so that we have the opportunity to try to resolve the issue promptly.
9.8 Where a payment dispute or chargeback is raised, we reserve the right to provide relevant information relating to the order, payment, delivery and communications to the payment provider or card issuer in order to respond to the dispute.
9.9 Nothing in this clause affects your statutory rights.
10. Delivery
10.1 We will deliver your order using the delivery option selected during checkout.
10.2 Delivery charges and estimated delivery times are shown before you complete your purchase.
10.3 Unless we have expressly agreed a specific delivery date, all delivery times are estimates only and are not guaranteed.
10.4 Delivery may be made in one or more consignments where this is reasonable. We will not charge additional delivery costs where we choose to split an order.
10.5 If a product becomes unavailable after we have accepted your order, we will contact you to discuss an alternative, a delayed delivery or a full refund.
10.6 You are responsible for ensuring that the delivery address provided is complete and accurate.
10.7 If a parcel is returned to us because:
- the address supplied was incorrect or incomplete;
- delivery was repeatedly attempted but unsuccessful;
- the parcel was refused without good reason; or
- the parcel was not collected from a collection point within the carrier's stated timescale,
we may ask you to pay the reasonable cost of re-delivery before sending the goods again.
10.8 Delivery is completed when the goods are delivered to the address you provided, or to another location agreed with you.
10.9 We may rely on delivery information supplied by our delivery partner, including tracking records, delivery scans, GPS data, delivery photographs or signatures, as evidence that delivery has taken place. This does not affect your statutory rights if the goods have not in fact been delivered.
10.10 We are not responsible for delays caused by circumstances beyond our reasonable control, including severe weather, industrial action, transport disruption, customs delays, supplier delays, technical failures or events described in Clause 19 (Events Outside Our Control).
11. Risk and Ownership
11.1 The risk in the goods passes to you when they are delivered to you or to a person identified by you to receive the goods.
11.2 Ownership of the goods passes to you only when:
- we have received payment in full; and
- the goods have been delivered.
11.3 If we refund your order following cancellation, return or rejection of the goods, ownership of the refunded goods passes back to us when the refund is made. You must take reasonable care of any goods awaiting collection or return.
12. Your Right to Cancel
12.1 If you are buying as a consumer, you have the right to cancel your order within 30 days without giving a reason.
12.2 The cancellation period ends 30 days after the day on which you, or a person nominated by you, receives the goods.
12.3 To exercise your right to cancel, you must clearly inform us of your decision before the cancellation period expires.
12.4 If your order consists of multiple deliveries, the cancellation period ends 30 days after you receive the final item.
13. Returns and Refunds
13.1 Where you exercise your legal right to cancel, you must return the goods to us within 14 days of notifying us that you wish to cancel.
13.2 Unless the goods are faulty, not as described or we have agreed otherwise, you are responsible for the cost of returning cancelled goods.
13.3 You must take reasonable care of the goods whilst they are in your possession. You may inspect the goods in the same way that you would be able to do in a shop, but you must not handle them more than is reasonably necessary to establish their nature, characteristics and functioning.
13.5 If you believe that goods are faulty, damaged or not as described, please contact us as soon as reasonably practicable so that we can investigate and agree the most appropriate remedy.
13.6 We will refund all sums due to you, including the cost of our standard delivery service where required by law.
13.7 Where goods have been delivered, we will endeavour to make any refund due to you without undue delay following the day on which we receive the returned goods or you provide satisfactory evidence that you have returned them, whichever occurs first. We may withhold the refund until one of those events occurs.
13.8 If you chose a more expensive delivery option than our standard delivery service, we are only required to refund the cost of our standard delivery service.
13.9 Refunds will be made using the same payment method used for the original purchase unless we agree otherwise.
13.10 Nothing in these Terms affects your legal rights in relation to faulty, damaged or incorrectly supplied goods under the Consumer Rights Act 2015. This includes your short-term right to reject faulty goods within 30 days where the Consumer Rights Act 2015 applies.
14. Faulty, Damaged or Incorrect Goods
14.1 If you believe your goods are faulty, damaged, defective or not as described, please contact us as soon as reasonably practicable after discovering the issue.
14.2 To help us investigate, we may ask you to provide:
- your order number;
- photographs of the goods;
- photographs of the packaging;
- a description of the issue; and
- any other information reasonably required to assess your claim.
14.3 Where appropriate, we may ask you to return the goods to us for inspection before confirming the appropriate remedy.
14.4 If your claim is valid, we will provide the remedy required by law, which may include a repair, replacement, price reduction or refund depending upon the circumstances.
14.4 Where we ask you to return faulty goods, we will reimburse reasonable return postage costs.
14.5 Nothing in these Terms affects your statutory rights.
15. Customer Reviews, Photographs and Other Content
15.1 We welcome reviews and feedback from our customers.
15.2 If you submit a review, photograph, video, testimonial, social media post or any other content to us, you confirm that:
- the content is your own or you have permission to submit it;
- it is truthful and accurate to the best of your knowledge;
- it does not infringe anyone else's intellectual property rights;
- it does not contain unlawful, defamatory, offensive, abusive or misleading material; and
- it may lawfully be used by us.
15.3 Any content you upload, post, submit or otherwise provide to us will be considered non-confidential and non-proprietary.
15.4 By uploading, posting, submitting or otherwise providing content to us, you grant Soleberie a non-exclusive, worldwide, perpetual, irrevocable, royalty-free licence to use, reproduce, publish, adapt, modify, translate, distribute and display that content for the purposes of operating, promoting, marketing and improving our website, products, services and business.
15.5 This licence includes use on:
- our website;
- social media;
- advertising;
- email marketing;
- printed material; and
- other promotional channels.
15.6 You confirm that you have all necessary rights and permissions to provide the content and to grant this licence to us.
15.6 We are not obliged to publish any content submitted to us.
15.7 We reserve the right to moderate, edit for length or format, refuse or remove content at our discretion, provided that we do not materially alter the meaning of a customer review.
15.8 Nothing in this clause affects your rights under applicable data protection legislation.
16. Intellectual Property
16.1 All intellectual property rights in our website and its contents belong to Soleberie or our licensors.
16.2 This includes, but is not limited to:
- our trade marks;
- logos;
- product names;
- photographs;
- graphics;
- illustrations;
- videos;
- text;
- website design;
- page layouts; and
- all other content made available on the website.
16.3 You may access and use our website solely for your own personal, non-commercial use.
16.4 You must not, without our prior written consent:
- copy;
- reproduce;
- republish;
- distribute;
- modify;
- scrape;
- commercially exploit; or
- create derivative works from,
any part of our website or its contents.
16.5 Nothing in these Terms grants you any ownership of our intellectual property rights.
17. Website Use
17.1 We make reasonable efforts to ensure that our website is available and functions correctly. You are responsible for ensuring that your device and software are suitable for accessing our website.
17.2 However, we do not guarantee that the website will always be:
- available;
- uninterrupted;
- free from errors; or
- free from viruses or other harmful components.
17.3 We may suspend, withdraw, update or change any part of the website without notice where reasonably necessary.
17.4 To the extent permitted by law, we are not liable for losses arising solely from temporary website unavailability or technical issues beyond our reasonable control.
18. Acceptable Use
18.1 You agree not to misuse our website.
18.2 In particular, you must not:
- introduce viruses, malware or malicious code;
- attempt unauthorised access to our systems;

18.3 We reserve the right to suspend or block access where we reasonably believe these Terms have been breached.
18.4 We may also report unlawful activity to the appropriate authorities.
19. Events Outside Our Reasonable Control
19.1 We shall not be responsible for any failure or delay in performing our obligations where such failure or delay results from circumstances beyond our reasonable control.
19.2 These may include, without limitation: severe weather; flood; fire; pandemic or epidemic; war; terrorism; civil unrest; industrial disputes; transport disruption; supplier failure; shortages of materials; interruption of utilities; cyber-attacks; failures of payment providers; failures of delivery companies; or acts of government.
19.3 If such an event significantly affects your order, we will notify you as soon as reasonably practicable.
19.4 Where the delay continues for an unreasonable period, you may cancel your order and receive a refund for any goods you have paid for but not received.
19.5 Nothing in this clause affects your statutory rights, including any right to cancel an order because goods have not been delivered within the period required by law.
20. Our Liability
20.1 Nothing in these Terms excludes or limits our liability where it would be unlawful to do so.
20.2 This includes liability for:
- death or personal injury caused by our negligence;
- fraud or fraudulent misrepresentation;
- breach of your statutory rights as a consumer; and
- any other liability which cannot legally be excluded or limited.
20.3 Subject to the above and to the fullest extent permitted by law, we shall not be liable for:
- any loss or damage that is not reasonably foreseeable;
- indirect or consequential loss;
- loss of profit;
- loss of revenue;
- loss of business;
- loss of commercial opportunity;
- loss of goodwill; or
- business interruption.
20.4 Our products are supplied for private and domestic use only. We make no representation that they are suitable for commercial, business or resale purposes. If you use our products for any commercial, business or resale purpose, we shall not be liable for any business loss, including loss of profit, loss of revenue, loss of contracts, loss of anticipated savings, loss of goodwill or business interruption.
20.5 Nothing in this clause affects your statutory rights under the Consumer Rights Act 2015.
21. Complaints
21.1 If you are unhappy with any aspect of your order or our service, please contact us using the details set out in these Terms.
21.2 To help us investigate, please provide:
- your name;
- your order number (if available); and
- details of your complaint.
21.3 We aim to acknowledge complaints promptly and to resolve them as quickly as reasonably possible.
21.4 If we cannot resolve your complaint immediately, we will keep you informed of our progress.
21.5 Nothing in this clause affects your legal rights.

22.1 We will process your personal information in accordance with our Privacy & Cookie Policy.

23. Changes to these Terms
23.1 We may amend these Terms from time to time.
23.2 The version that applies to your purchase will be the version published on our website at the time your order is placed.
23.3 Any changes will not affect orders that we have already accepted.
24. Entire Agreement
24.1 These Terms, together with any documents expressly referred to within them, constitute the entire agreement between you and us relating to your purchase.
24.2 Nothing in this clause excludes or limits liability for fraud or fraudulent misrepresentation, or affects your statutory rights as a consumer.
25. Invalid Provisions
25.1 If any provision of these Terms is held to be invalid, unlawful or unenforceable, that provision shall be treated as modified to the minimum extent necessary to make it enforceable.
25.2 If modification is not possible, the provision shall be treated as deleted.
25.3 The remaining provisions shall continue in full force and effect.
26. Waiver
If we delay or choose not to enforce any provision of these Terms, this shall not prevent us from enforcing that provision or any other provision at a later date.
27. Transfer of Rights
27.1 We may transfer our rights and obligations under these Terms to another organisation, provided that doing so does not adversely affect your rights.
27.2 You may not transfer your rights or obligations under these Terms without our prior written consent.
28. Third Party Rights
28.1 These Terms are between you and us.
28.2 No person other than you and Gubblecote Ltd trading as Soleberie has any right to enforce any provision of these Terms under the Contracts (Rights of Third Parties) Act 1999.
29. Governing Law and Jurisdiction
29.1 These Terms and any dispute or claim arising out of or in connection with them (including any non-contractual dispute or claim) shall be governed by and interpreted in accordance with the laws of England and Wales.
29.2 If you are a consumer resident in the United Kingdom, you may bring legal proceedings in relation to these Terms in the courts of the part of the United Kingdom in which you live. We may bring legal proceedings against you only in the courts of the part of the United Kingdom in which you live.
29.3 If you are not a consumer resident in the United Kingdom, the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms (including any non-contractual dispute or claim).
